| Do you want a Show Horse or a War Horse? You have heard of days of old when there were Knights in shining armor that fought against tyranny and oppression. These men of valor rode upon mounted steeds that wore armor and charged unto the battlefield snorting and attacking just as hard as the Knights they carried. These Warhorses of old feared nothing and lived for the day of battle, excited by the smell of the contest. Then there are Showhorses*** - pretty, primped, pampered but pathetic when the battle begins. Costly for sure, but no scars of battle upon them, no notches in their saddles for the victories won. Good to have at the County Fair to win a blue ribbon but a sad excuse in the day of battle. ***An empty suit to escort you straight to a guilty plea and a lifetime conviction for DWI. Make no mistake about it - there is a war on Drunk Driving and you do not want to become another casualty by picking the wrong horse to ride into battle. And as you may be very aware of by now, innocent Americans are being arrested and charged with DWI every night and day in Texas. I cannot begin to describe the number of clients we represent that were absolutely NOT intoxicated when they were arrested and charged with DWI. This happens in every jurisdiction where we practice. Think about how the so-called "field sobriety tests" are designed for failure. When would you normally walk heel to toe for nine steps and then back again. Were you asked to stand on one leg and count to thirty when you took your Drivers License test? How do these agility exercises show your normal ability to drive? What allowances are made for your individual problems with coordination, fatigue, physical or medical issues, allergies, illness or just being unprepared. Why aren't you allowed to practice, even just once before you try exercises they have done hundreds of times. When you consider the amount of money the State of Texas and the various Law Enforcement agencies have at their disposal to spend in this war, it is staggering. Consider that prosecutors and judges attend the same seminars that spread the propaganda of MADD and other "victims" groups. They work in the same courtrooms together and get to know each others ways. They develop an attitude of "us versus them" and you are "them". And just who do you want marching into the courtroom battlefield with you to fight for your reputation, your good name, your honor? A Warhorse or a Showhorse? At the Law Office of Jamie Balagia we have established a stable of battle proven veteran trial lawyers. We don't win every battle but we bring in every weapon available and we will try any case, anytime, anywhere to defend our clients' rights, livelihood, reputation and good name. We consider it an honor to represent the citizen accused of drunk driving and we will do everything that ethics and the rules of court will allow us in order to emerge victorious from the battle. |
