The Leander Police Department arrested beleaguered Austin Police Officer Leonardo Quintana this afternoon on Misdemeanor charges related to year old allegations concerning a relationship he had with a female Austin Police Officer. Officer Quintana was charged with two counts of Misdemeanor Assault, one count of Misdemeanor Criminal Trespass and one count of Misdemeanor Criminal Mischief. Officer Quintana was arrested and booked into the Williamson County Jail by officers with the Leander Police Department. Officer Quintana meet with investigators with the Leander Police Department yesterday and was advised by attorney Jamie Balagia to expect to be arrested today.
 
The anonymous female officer has given two versions of the events that occurred over a year ago during the relationship. No charges have been filed against the female officer even though she has engaged in criminal activity by lying to law enforcement officers and committing perjury during the yearlong investigation into her allegations. Last month the Williamson County Attorney’s Office filed a Protective Order Motion to determine whether the Courts would support a Protective Order against Quintana. That hearing is set for later this month. This is almost unheard of in a case with allegations over a year old where there has been no contact between the parties since December of 2009.
 
Attorney Balagia states that “this arrest is nothing more than sour grapes by the Austin Police Department because of the recent arbitration decision that ordered the Department to reinstate Quintana to his position as an Austin Police officer.” According to Balagia “APD will stop at nothing in its vengeance to destroy officer Quintana’s career”. If Quintana is found guilty (or receives a deferred adjudication) for family violence assault he will be prohibited from possessing a firearm which would result in his inability to work as a police officer and APD could fire him. If Quintana is found guilty (or receives deferred adjudication) of any Misdemeanor crime he will lose his TCLEOSE Peace Officer License and the department could fire him.
 
Balagia believes that the Austin Police Department is “the tail wagging the dog in Williamson County” in regard to the Protective Order Motion and the Misdemeanor arrests today. “One thing is certain, the Austin Police Department is bringing Hell down on Lenny’s head and the abuse by APD is nothing new”. Balagia also questioned the financial damage that APD could be causing the Austin taxpayers since officer Quintana is involved in two lawsuits steaming from a shooting incident that resulted in the death of one man and another man being wounded.
