San Antonio Police Officer Arrested for DWI

We recently wrote about an Austin police officer who was arrested for DWI, and here’s a similar story: Last month, a 36-year-old San Antonio police officer was arrested on suspicion of DWI. According to My SA News, the officer was driving a white Ford F-250 on FM 1283 in Lakehills near Medina Lake when he was stopped — police had received calls about a vehicle driving recklessly.

The man failed a field sobriety test and was taken to Bandera County Jail where he refused to take a breathalyzer test.

San Antonio police Sgt. Chris Benavides stated that the officer was “placed on administrative leave pending an internal investigation,” adding that the department would be conducting a “thorough but swift investigation” and that this form of misconduct would not be tolerated.

Field Sobriety Tests: Should You Take Them?

It’s a question we hear often, and the answer is short: No, you should not take the field sobriety tests. Some things to think about: There are many ways to discredit field sobriety tests, one being that field sobriety tests are not scientific. People with a vested interest in getting their version of the so-called tests accepted by law enforcement agencies performed the original “studies” — and the creators have continued to profit ever since. Another way to discredit field sobriety tests is if the officer did not follow the standardized protocol while demonstrating and explaining the tests.

There are several other ways to discredit the field sobriety tests, like your age or weight — if you’re over 65 years old or 50 pounds over your recommended weight, you shouldn’t be required to perform the tests.
